Solar Farm Regulation in Illinois


Multiple solar farm companies have proposed building solar facilities in McHenry County, Illinois, this year. However, a new state law limits the county's authority to regulate commercial solar farms, making it challenging for the McHenry County Board to address concerns about locations, runoff, and flooding.

Seven solar farms are planned in the county, including Solar Stone in Harvard, Wildcat in Woodstock, Surya Powered in Hebron and Crystal Lake, and Solar 9000 in Huntley, Marengo, and Union. The Surya Powered LLC solar farm, covering over 20 acres in Crystal Lake, was narrowly approved as a community solar project.

Residents and board members raised worries about flooding and runoff issues, especially in the Crystal Lake watershed.

The current state law restricts the board's ability to object to solar farm proposals that meet planning and zoning requirements. The board plans to approve existing proposals and seeks a potential change in the law for more control.

Board member Pamela Althoff will propose an amendment to give county boards more authority once a certain solar farm acreage is reached. The board aims to discuss with lawmakers for support. Voting against the farms could lead to legal action by the state.

Illinois targets 40% renewable energy by 2030 and 50% by 2040 through the Climate and Equitable Jobs Act. Board members support solar farms but want proper implementation for environmental protection
