USDA Ordered to Pay SNAP Benefits

A federal judge in Massachusetts has ruled that the U.S. Department of Agriculture (USDA) must use its contingency funds to continue the Supplemental Nutrition Assistance Program (SNAP) during the ongoing federal government shutdown.

The decision follows a lawsuit filed by a coalition of 26 attorneys general and governors, including Illinois Attorney General Kwame Raoul.

Raoul praised the court’s decision, stating that it reaffirms the importance of the rule of law and the separation of powers. He emphasized that nearly two million Illinois residents depend on SNAP benefits for access to nutritious food.

According to Raoul, the government’s decision to halt benefits was both unlawful and harmful to families who are already struggling.

The federal court found that the USDA’s suspension of SNAP benefits violated federal law, noting that Congress had already appropriated funding for the program. The court further directed USDA to inform by November 3 whether it would fully or partially fund SNAP benefits for November.

The coalition argued that ending SNAP benefits would have devastating effects on millions of Americans and increase pressure on food pantries and community organizations.

They also contended that the USDA’s actions were arbitrary and capricious under the Administrative Procedure Act, lacking any legal authority to stop funding.

Joining Raoul in the lawsuit were attorneys general from states including California, New York, Minnesota, Oregon, and Washington, as well as the governors of Kansas, Kentucky, and Pennsylvania. Together, they aim to ensure that families nationwide continue receiving food assistance despite the shutdown.

The ruling provides temporary relief and ensures that SNAP participants will not lose access to essential benefits while the case proceeds, highlighting the critical role of state leadership in safeguarding public welfare.
